Hey, my friend just got admission in a college and since she is not a US citizen or permanent resident. So, she needed a co-signer who is one but unfortunetly she couldnt get one cuz no one other then your own family member will trust u and sign and affidavit or co-sign a loan. Now her aunt who came with her husband on his work visa,been living for 9 yrs, recetly went out of status(I dont know the reason as its personal) has bank account and of course some savings. So my friend's aunt signed the Affidavit for my friend that was required by the university in order to process the student visa. Now after the application is filed, my friend is worried and maybe you can help her answer the questions. Her english isnt so good so Im going this for her(thu mine is bad too :)
-I do know one thing that if a person getting a student loan is not a US citizen/permanent resident she/he would need a co-signer who is one and I also know that for sure that the loan agency check the credit history of a co-signer. is you will be paying double fees.USCIS will automatically deny 1 case when the other one is approved.
I am in the same situation (but my PD is 1 year earlier than my wife) but I am just filing my case and holding of my wife's I-140.

I happened to read the following on a different thread on IV
"for cases that has to be filed by overnight courier that is by the USPS Express Mail the center will only pick up mails from the U.S Postal Service once a day and in the morning. Therefore any mail that is not picked up in the morning will be picked only the following day and is given a next day receipt date."
Does it mean that any packages that were sent out yesterday(Thursday) will be delivered today(Friday), but USCIS will only pick it up on Monday morning and then assign Monday as the receipt date? Anyone with some knowledge on this, please clarify.

it is always recommended to file h1 extension. If your company is not willing to file for an extension, you will have to use EAD to work for them. Once you started using EAD, your non-immigrant status (h1) is invalidated. Hence , you can not apply for H4 extension for your spouse/dependants - they will be in "pending AOS" status, entire family needs to have AP to travel outside and enter USA.
BTW, you will have file I-539, it is faily simple, goto USCIS site and download the forms.

A receipt of notice is generated immediately. As soon as your application reaches the USCIS ofice they generate the receipt of notice and post mail it to the attorney. It takes 2-3 days for the mail to reach your attorney so we can assume that the total time to get the receipt of notice from the day it was filed should not be greater than 4-5 days.
thanks for your reply. My I-140 petition should have reached NSC on 13th October. Assuming that they mailed the receipt notice latest by 15th October by regular mail which takes 2-3 business days, should my attorney not have received something by today (25th october -6th business day). Is this normal or an unusual delay??

It is their error and mistake. There is no time to correct. So, officer should understand.
becuase, his / her previous approval notices / I-94 copy on approval notice - the lower left part and I-94 the lower right part should have correct start and end dates. he can carry them.
In my son's I-94, the one previous to the lat/latest one, his country of citizenship was notes as Oman (and not India). During the last renwal, it was corrected to India. My attorney placed a note.
I went to Vancouver, BC in March 07 and got H1s stamped.
Any other experiences. Please, take a moment and share.

But the Visa validity start date in his I-797A is incorrect. He joined this company only in 2006 but the start date shown in I-797A is sometime in 2001.
Though the END date is correct, Is it going to cause any problem in his Visa stamping?
He got only 2 weeks to fly and skeptical about the turnaround timeframe to file for correction.
His lawyer says it is a very minor problem and will not affect the visa stamping.
Please share any similar experiences / ideas.

Although I haven't confirmed, information of Sportsshooter is usually very reliable. Sounds like a lot of issues that were reported indeed were true. The 1D had an early fix after it's initial release as well. If true, it looks like Nikon is addressing the issues.

I would assume that EAD and AP have to be paid for separately.

Hi,
I have an EAD (over a year now since I-140 approved), but never used it. Now, that Iam planning to switch my employer I have some questions about using EAD
1. Is it Mandatory to file AC21?
2. Is AC21 required for each contract switch ? (Suppose Contract is W2), if so, wouldnt that be hard and expensive to file for every 3 or 6 months projects?
3. Can I work on 1099?

What if the case is where I want to take up a new full time position and convert my current full time position to part time.....I guess one way to do it would be to transfer H1 to the new employer...wait for an approval and then file for another concurrent H1 for the part time job with the old company..But the problem is I'd have to wait until new approval comes...and also convince both companies to shell out 2k plus in filing fees....does any one have a better alternative ? We will sit idle and they will sit idle till the PD moves. Once the PD moves, they MIGHT get some 485 applications to process. Since the PD is retrogressed four to five years last year, most of the people with PD till the end of 2003 have already filed 485. The movement of PD until 2003 end will add some 485 to USCIS.
The real fun to watch is when the PD moves beyond Jan'04. The service center will be flooded with 485 applicaitons and the flood will keep on increasing as the dates move. Lots of permutations and combinations are invloved in this scenario.
