Hi
I am going to apply for i-485,
i have birth certificate which is taken in 2005 but I was born in 1974
some of my friends are saying...as you are born in 1974 and as your
birth certificate was taken in yr 2005, it might cause problems (ins poseses query)
to get the green card.
Is it right?
They are saying me to get Affidivits + non availability certificate now.
will it be a problem if I put my birth certificate....while applying for 485

My EB3 AOS was filed in July, 2007.
I have a valid H1 upto July, 2010 and my EAD expires September, 2010.
My wife and daughter have valid H4 upto July, 2010 and their EAD expires September, 2010. Both have used EAD.
APs are expiring in July 2010 for all of us.
My employer has filed for H1 extension.
I have couple of questions regarding my family�s statuses;
1. If my wife and daughter do not want to renew their EADs/APs (or renewal gets delayed beyond September, 2010), what is their legal status in US as they don�t have a valid I-94?
2. As they already used EADs, I think they are not eligible for H4 filing. Can someone confirm?
3. Does anyone have experience of renewing Driving license without EAD or H4 during AOS?

I got my first 3 year H1 extention from 2006-2009. Now I am appllying for my next 3 years H1 extention. However, I am seeing USCIS asking for client letter and copy of contract. Additionally, one employee of my company got renewal for 3 months only, since his project was getting over in 3 months.
My company gets Purchase Orders for 1 year duration only from my client, but I have a intent to renewal for up to 3 years. I am about to enter into my 2nd year of contract.
I am working with my lawyer to present my case the best way to ensure that we get a renewal of 3 years. Here is what my lawyer recently stated

If individual have US degree (Bachelor of Science in Nursing) along with B. SC in Microbiology from Indian, 1 yr Medical Lab Technician Course and 18 months Lab Assistance experience. Individual is on H4 visa, based on above qualification would student eligible for H1B visa? Person does not have SSN so do not qualify to get RN license in CA state. Any useful response will be kindly appreciated.

0. Keep docs ready for MTR and once you receive the response from INS you should able to reply immed.
Without denial notice, I am not sure what kind of documents are required for MTR response. This I-140 was denied even without any RFE. There is no clue to guess the reason for denial.

How long it take (in terms day) to receive actual RFE mail notice after LUD status update online about RFE?
No RFE so far. Like I said all I see is new LUDs and all the online messages on i-485 cases say "case received and pending" on all cases. All cases are at Nebraska.

But both of my labor certifcates are from the same company. I read somewhere I-140 is for intending to employ me. How can they employ me in two categories one on EB3 and one on EB2.
Do you see any disadvantage if I file both from the same company.

The only impact will be that you will lose your earlier PD (if 140 gets approved).......Also, it could cause you issues with H1 extensions if you are in 6th year of your H1 and are re-starting the GC process....Note that your LC/I-140 must be filed or should be pending for 365 days or your I-140 must be approved in order to get H1 extensions beyond the 6 year term....

My Present H1B stamp is with company A and expires November 20 2007. Now I'm with company B and with this I have my petetion (H1B approval) which expires June 20 2008. Now I'm travelling to India for my marriage and coming back September 8. I'm not getting the new stamp this time. Will I have any problem during the immigration ??
Also with my present papers, my wife would be attending her visa Interview on Sep 4. Will there be any problem for her at the interview ???
