    hello, I am in a F1 status for about 3 years, I have been working and filing taxes. I am going to get married to a USC and apply for a green card through it. I want to know if I can have any problem in the aplication since I've been working without authorization. Second in concern to the affidavit support how much should I show and who has to fill these forms since my future wife is unemployed. Third in case my wife file for bankruptcy in the future that could affect me and if it does how can avoid this. By the way I live in florida.

    It looks like we just missed a great opportunity to post a legal immigration question on change.gov. The goods news is that they will roll this out next week. So if you want to submit a question, be ready!...I will be sure to bump this thread..

    Thanks for the suggestions Fred! I applied a bit more sharpening to the head, I think it's not so OOF looking now. I'll have a go at cloning out the twigs later, it looks a bit difficult but it could be fun trying.

    Hi,

    Here is my current Status :

    I485 : Filed in July 2007
    PD : April 2006
    EAD : Valid till 27th August 2010 (filed for renewal last week)
    AP : Valid till Jan 22nd 2011
    H1B : Valid till Jan 22nd 2011

    My employer is still the same who filed for my GC (and helping me keep my H1 current) Last couple of time when I went to India I have used AP to re-enter the US. My wife used her EAD to get a job locally - but now she has quite and she is in India. . I am currently in process of getting my H1 stamped on my passport, get H4 for my wife and son (who was born on July 30 2010 in India)

    MY QUESTION IS : What should we use to re-enter the US ? AP or H1/H4 ?
    Will my H1 and EAD still be valid ? or will I lose one of them ?

    Please let me know. I do not want to take a wrong step since I am so close to getting my GC.

    Certain felonies make a person inadmissible, which means no Green Card may be issued for such a person for either 15 years of indefinitely. You need to be more specific. Crimes of moral turpitude are inclusive. There are some limited waivers for some, but not all grounds of inadmissibility.

    I dont think you have understood the question. The OP asking what if the sponsoring person is deported due to feloney charge.

    I am getting this error for last two days
    "Multiple duplicate SRs already exist for the customer" i tried creating different account also . any thoughts???

    Received the RFE today. It was asking for my birth certificate copy & translation. My lawyer says this is very common. For me this is stupid, they already got my birth certificate copy and the translation.

    Unless otherwise you invoke her H1, she will be in H4 even if H1 is approved today. Invoking means, going to home country and getting it stamped or start working for a company and getting paid via paystub and having SSN

    Why do you need color visa copy?. Is it mandetory for AP? News for me.:confused:

    It is not mandatory but there have been instances USCIS have requested colour copy of visa .

    But she has to travel to India in the next 2 weeks and also my I-797 will not be approved till another 2 months.

    Anybody else has any other suggestions for the question above.

    I was in the same boat and I can tell you that you have to pretty much depand on your company attorney. In my case it took 2-3 inch thick stack of documents to prove the relationship of the US company with its foreign subsidiary and if you are trying to get L-1A (multinational executive/manager), it will take another bunch of documents to prove your credibility, your existing status with the company as a manager/executive in the foreign subsidiary, your proposed role in the US company and a lot more. I guess it would be wise for you to let the attorney handle the case as you probably won't have much to do with the whole process. However, the positive news for you is that almost all of the well documented and properly filed L-1 petitions are approved by USCIS, and any experienced immigration attorney won’t have much of a problem getting you approved.:)

    I e-filed My I-765 and needs to send in my supporting documentation .

    I know there was a recent bulletin that changed the filing location of I-765 .

    Hi,
    My employer has been playing this game with me. He filed for my Labour and it got approved in August of 2007. However he did not file for my I-140 until Feb of 2008 , just a week before the labour would expire. Now its been over year , he does not give me my SRC number but keeps telling me its been approved under EB-2 catagory. As for me , I am current in EB-2 , I just checked April Bulletin and I still am current. It looks like he is not going to file for my 485. Is there anyway I can make him file or file myself. Please know, the lawyer is on his side as well. I have asked the lawyer number of times for SRC number but he does not provide that either. What are my option other than joining a new company.

    Previously worked on H-1B visa for six years. Left US when visa expired.
    Then worked in Canada for 6 years.

    Currently on TN-1 Visa with 13 years of IT Program Management and IT Project Management, IT Governance and IT Audit experience.

    Looking for a company willing and able to apply for Labor Certification in this short duration, so I can apply for I-140 and I-485 before August 17th.

    Thank you for your information and advice.

    Out of curiosity: How do you expect to get your LC through PERM approved before August 17th?

    Hello All,

    My first I-140 (EB3) got denied and is pending in appeals office for more than 1-1/2 years. Since 140 was denied my 485 was also denied.

    Later we filed new labor (in 2009) and 140 (EB-2) and got approval after 8 months.

    My questions are:

    1. Can I file 'motion to reopen' for 485s based on new 140 approval and use the previous priority date (which is 2004)?

    2. If not, can I file motion to reopen 485 based on old 140 (which is pending in appeals office) and later if they are open, can we link these 485s with new 140?

    Please advise.
